These terms govern your use of https://kimchihalfie.com, operated by KIMCHI IV, LLC ("Kimchi Halfie", "we", "us"). Please read them carefully.
1. Acceptance of these terms
By accessing the site, creating an account, subscribing, or buying from our kitchen store, you agree to these terms and to our privacy policy. If you do not agree, please do not use the site.
2. Membership and subscription billing
A Kimchi Halfie membership gives you access to our full recipe library. Plans are offered on a monthly basis at $9.49 and on an annual basis at $99.49, each starting with a 30-day free trial. You authorize us and our payment processor to charge your payment method according to the plan you select.
3. Auto-renewal, in plain language
Here is exactly how billing works. Your membership begins with a 30-day free trial during which you are not charged. If you do not cancel before the trial ends, your membership automatically converts to a paid plan, and your payment method is charged the recurring fee for your plan. After that, your membership renews automatically at the end of each billing period (monthly or annual) at the then-current rate, and your payment method is charged each period until you cancel. We will continue to charge you on this recurring basis until you turn off renewal.
4. How to cancel
You can cancel any time, including during your free trial, directly from your account page in a couple of clicks. There are no cancellation fees and no phone calls required. When you cancel, you keep access through the end of the period you have already paid for, and you will not be charged again.
5. Kitchen-store orders and shipping
Kitchen-store prices are shown in US dollars. Standard shipping applies within the contiguous United States, and orders over $75 ship free. Orders ship from Florida, typically within one to two business days. Title and risk of loss pass to you upon delivery to the carrier.
6. Refunds
Purchases are covered by our 30-day money-back guarantee, subject to the terms in our refund and return policy, which is incorporated into these terms by reference.
7. Acceptable use
You agree not to misuse the site: no scraping or bulk copying of recipes, no reselling or redistributing our content, no attempts to breach security, and no use that violates the law or infringes the rights of others. We may suspend or terminate accounts that violate these terms.
8. Intellectual property
All recipes, text, photography, branding, and other content on the site are owned by KIMCHI IV, LLC or its licensors and are protected by intellectual property laws. Your membership grants you a personal, non-transferable right to access and cook from our content for your own use. It does not transfer ownership or allow republication.
9. Disclaimers
The site and its content are provided "as is" without warranties of any kind. Recipes, nutritional figures, and cooking guidance are provided for general information; results vary, and you are responsible for safe food handling. See our disclaimer for details.
10. Limitation of liability
To the fullest extent permitted by law, KIMCHI IV, LLC will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the site or our products, and our total liability for any claim will not exceed the amount you paid us in the twelve months before the claim.
11. Governing law
These terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules.
12. Binding arbitration and class action waiver
Please read this section carefully, as it affects your legal rights. Any dispute arising out of or relating to these terms or your use of the site will be resolved by final and binding individual arbitration administered under applicable arbitration rules, rather than in court, except that either party may bring qualifying claims in small claims court. You and KIMCHI IV, LLC each waive the right to a trial by jury. You also agree that disputes will be brought only in your individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The class action waiver applies to the fullest extent permitted by law.
13. Changes to these terms
We may update these terms from time to time. When we do, we will revise the date above, and significant changes may be communicated by email or an on-site notice. Continued use of the site after changes take effect means you accept the updated terms.
